According to the relevant laws and regulations of our country, if the people's court decides that both parties divorce, the joint debt shall be repaid by the common property of both parties. If the common property is insufficient to pay off, or the property belongs to each party, the two parties shall settle it by agreement. If the court has a judgment, the court judgment shall prevail.

Article 41 At the time of divorce, the debts originally borne by the husband and wife in their common life shall be repaid jointly. If the joint property is not enough to pay off, or if the property belongs to each other, the two parties shall reach an agreement on payment, and the people's court shall make a judgment.
