According to the laws and regulations of our country, the amount of childcare fees is determined. First of all, the parents should negotiate. If the negotiation fails, they can sue to the people's court and the people's court will make a judgment. Whether it is a negotiation or a judgment, it should be determined based on three factors: first, the actual needs of children's growth, second, the actual bearing capacity of both parents, and third, the actual living standard of the local people. Even if both parents agree that the child shall live with one party and the supporting party shall bear all the child support, the court shall also verify whether both parties meet the above basis.
There are three specific calculation methods for determining child support:
First, if there is a fixed income, the childcare fees can generally be paid at the rate of 20-30% of the total monthly income. If there are more than two children to bear the childcare fees, the rate can be appropriately increased, but generally not more than 50% of the total monthly income.
Second, if there is no fixed income, the amount of childcare fees can be determined according to the total income of the year or the average income of the same industry, with reference to the above proportion.
Third, under special circumstances, the above proportion can be appropriately increased or reduced.
Article 7 of the Notice of the Supreme People's Court on Printing and Distributing Several Specific Opinions of the People's Court on Handling Child Support Issues in the Trial of Divorce Cases
The amount of childcare fees may be determined according to the actual needs of the children, the affordability of both parents and the actual local living standard.
If there is a fixed income, childcare fees can generally be paid at the rate of 20% to 30% of the total monthly income. The proportion of those who pay for the upbringing of two or more children may be appropriately increased, but generally shall not exceed 50% of the total monthly income.
If there is no fixed income, the amount of childcare fees can be determined according to the total income of the year or the average income of the same industry, with reference to the above proportion.
In case of special circumstances, the above proportion can be appropriately increased or reduced.
