The crime of intentionally divulging state secrets refers to the serious act of state functionaries who intentionally divulge state secrets in violation of the provisions of the State Secrets Law. The so-called state secrets refer to the matters that are related to the security and interests of the country and are determined according to legal procedures and are only known to a certain range of people within a certain period of time.
Crime of intentionally divulging State secrets Any functionary of a State organ who, in violation of the provisions of the Law on Guarding State Secrets, intentionally or negligently divulges State secrets, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention; If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years.

If a person who is not a functionary of a State organ commits the crime mentioned in the preceding paragraph, he shall be punished according to the provisions of the preceding paragraph as appropriate.
