There are two ways to divide the joint property of husband and wife: agreement division and judgment division. At the time of divorce, if the two parties have legally agreed on marital property, the matter shall be handled in accordance with the agreement.
The unique property of one party belongs to itself. The joint property of husband and wife shall be divided equally in general, or unequal when necessary. If there is a dispute, the people's court shall make a judgment according to law.
