The divorce can be filed in the court of the other party's registered permanent residence. If the other party's registered permanent residence is different from its habitual residence, the divorce can be filed in the court of the other party's habitual residence. If the other party has not lived in other places for more than one year, the divorce can be filed in its original residence or marriage registration place.
According to Article 12 of the Opinions on Several Issues of the Civil Procedure Law, a case in which one of the husband and wife has left the place of residence for more than one year and the other party filed for divorce shall be under the jurisdiction of the people's court in the place where the plaintiff resides. If the husband and wife have left their places of residence for more than one year and one party files a lawsuit for divorce, the case shall be under the jurisdiction of the people's court of the defendant's habitual residence; If there is no habitual residence, the people's court of the place where the plaintiff resides at the time of bringing a lawsuit shall have jurisdiction.
Article 12 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of the Civil Procedure Law of the People's Republic of China
