The right of final interpretation is illegal.
The Measures for the Supervision and Handling of Contract Violations clearly states that operators shall not infringe upon the rights of consumers under the pretext of "final interpretation right". According to the provisions of the Civil Code, the "right of final interpretation" clause attached by merchants in their promotional advertisements violates the principle of fairness and the mandatory provisions of the Contract Law, and is invalid. The "right of final interpretation" clause of merchants cannot exempt them from their legal responsibilities.
Legal basis:
Article 11 of the Measures for the Supervision and Handling of Contract Violations
Where a business operator enters into a contract with a consumer using standard terms, the business operator shall not exclude the following rights of the consumer from the standard terms:
(1) The right to change or terminate the contract according to law;
(2) The right to request payment of liquidated damages;
(3) The right to claim damages;
(4) The right to interpret standard terms;
(5) The right to bring a lawsuit on the dispute of standard terms;
(6) Other rights that consumers should enjoy according to law.
