There are two main procedures in China:
(1) Administrative procedures. That is, the procedure of voluntary divorce. Both men and women who wish to divorce must apply for divorce in person at the registration office of the place where one party's household registration is located. The marriage registration authority shall approve or disapprove the registration in accordance with the law after verifying whether the two parties are really willing and whether they have properly dealt with children and property and life after divorce. When the registration is approved, the marriage certificate shall be withdrawn and the divorce certificate issued.
(2) Proceedings. That is, the procedure for one party to request divorce. The party requesting divorce may file a divorce lawsuit with the people's court where the defendant is located. After the people's court accepts a divorce case, it first conducts mediation. If the mediation is successful, it will be treated as withdrawal of the lawsuit. If a divorce agreement is reached after mediation, a mediation statement will be prepared and a divorce agreement will be reached; If the mediation is invalid, the people's court shall make a judgment to approve or disapprove the divorce according to law.
