There are two cases of "top package" behavior after a traffic accident. In the case of not constituting a crime, the "top package" person belongs to an act that impairs the social management order and will be subject to administrative punishment.
 If the perpetrator constitutes a crime, the "top package" person is suspected of constituting the crime of shielding. According to the provisions of the Criminal Law, anyone who knowingly provides the other party with a hiding place, property, helps the other party escape or provides false evidence to protect the other party commits a crime of shielding.

 Article 310 of the Criminal Law of the People's Republic of China states that anyone who knowingly provides a hiding place, money or property for a criminal, helps him escape or makes false certificates to cover up, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years.
 Whoever conspires in advance to commit the crime mentioned in the preceding paragraph shall be regarded as a joint crime and punished.
