Guardianship is the right of identity enjoyed by guardians to supervise and protect the personal rights and property rights of persons without civil capacity and persons with limited capacity, such as minors and mental patients.
It is a legal qualification to manage and protect the legitimate rights and interests of minors and adult mental patients with no or limited capacity for civil conduct. Custody right refers to a personal right of parents to their children. There are two kinds of custody: legitimate custody and illegitimate custody.
Guardianship is distinguished from the legal principle and belongs to the right of identity in the Family Law. However, the guardianship system emphasizes more on the compulsion of the state to individuals and the obedience of individuals to family and social interests.
