    Individual patent application is:

    1. Where an application for a patent for invention or utility model is filed, a request, a description and its abstract and claims shall be submitted to the patent administration department under the State Council;

    2. Where an application for a patent for design is filed, a request, pictures or photographs of the design and a brief description of the design shall be submitted.

    Article 26 of the Patent Law states that anyone who applies for a patent for invention or utility model shall submit a request, a description and its abstract, claims and other documents. The request shall state the title of the invention or utility model, the name of the inventor, the name and address of the applicant, and other matters. The description shall give a clear and complete description of the invention or utility model, which can be realized by a person skilled in the technical field; When necessary, drawings shall be attached. The abstract shall briefly describe the technical essentials of the invention or utility model. The claims shall, on the basis of the specification, clearly and briefly define the scope of patent protection claimed. For inventions and creations that rely on genetic resources, the applicant shall state the direct source and original source of the genetic resources in the patent application documents; If the applicant is unable to state the original source, it shall state the reasons.
