 If a person with limited capacity for civil conduct suffers personal damage during his study and life at school, and the school fails to fulfill its educational and administrative duties, it shall bear responsibility.
 Persons with limited capacity for civil conduct refer to minors aged 10 to 18, but those who have reached the age of 16 but not the age of 18 and who use their own labor as the main source of income are regarded as persons with full capacity for civil conduct. If the competent person of the restricted act causes harm to others, the guardian shall bear the tort liability.
 Article 1199 of the Civil Code of the People's Republic of China states that if a person without civil capacity suffers personal injury during his study or life in a kindergarten, school or other educational institution, the kindergarten, school or other educational institution shall bear the liability for tort; However, those who can prove that they have fulfilled their educational and management responsibilities will not be liable for infringement.
 Article 1200 Where a person with limited capacity for civil conduct suffers personal injury during his study or life in a school or other institution of education, and the school or other institution of education fails to perform its educational and administrative duties, he shall bear liability for tort.
 Article 1201 If a person without or with limited capacity for civil conduct suffers personal injury from a third person other than a kindergarten, school or other educational institution during his study or life in a kindergarten, school or other educational institution, the third person shall bear the liability for tort; If kindergartens, schools or other educational institutions fail to fulfill their management responsibilities, they shall assume corresponding supplementary responsibilities. Kindergartens, schools or other institutions of education may claim compensation from a third party after assuming the supplementary responsibility.
