After signing a mediation statement, one cannot renege, and the effective mediation statement has the same effect as the judgment.
According to the law, if the parties agree that the mediation agreement will become effective after being signed or stamped by both parties after the mediation agreement is reached and reviewed by the judges, the mediation agreement will become legally effective from the date of signature or stamping by both parties. If the parties request to extract or copy the mediation agreement, they shall be allowed to do so.
If the mediation agreement conforms to the provisions of the preceding paragraph, the people's court shall prepare a separate civil mediation statement. If one party refuses to perform the mediation agreement after it takes effect, the other party may apply for compulsory execution with the civil mediation statement.
Of course, if the parties request to prepare a mediation statement, the people's court may prepare a mediation statement and serve it on the parties after examination and confirmation. If the parties refuse to accept the mediation agreement, the validity of the mediation agreement shall not be affected.
According to Article 97 of the Civil Procedure Law of the People's Republic of China, when an agreement is reached through mediation, the people's court shall prepare a mediation statement. The mediation statement shall clearly state the claims, the facts of the case and the mediation results. The conciliation statement shall be signed by the judges and the court clerk, sealed by the people's court, and served on both parties. The mediation statement shall have legal effect once signed by both parties.
