    Article 31 of the Several Provisions of the Supreme People's Court on Evidence in Civil Procedure states that the party applying for appraisal shall submit the application within the period specified by the people's court and pay appraisal fees in advance. If the applicant fails to file an application or pay appraisal fees in advance within the time limit, the application shall be deemed to have been abandoned. If the party who bears the burden of proof for the facts to be proved that need to be identified fails to apply for identification or pay identification fees in advance without justified reasons, or refuses to provide relevant materials within the period specified by the people's court, which makes it impossible to find out the facts to be proved, it shall bear the legal consequences of the failure to provide evidence.

    Article 32 If the people's court grants the application for expert evaluation, it shall organize the parties concerned to determine through consultation the appraisers with corresponding qualifications. If the parties fail to reach an agreement through consultation, the people's court shall appoint them. If a people's court entrusts an expert evaluation according to its functions and powers, it may appoint an expert evaluation person with corresponding qualifications after asking the parties for their opinions. After determining the appraiser, the people's court shall issue a power of attorney, which shall specify the appraisal items, scope, purpose and time limit.

    Legal basis

    Article 32 of Several Provisions of the Supreme People's Court on Evidence in Civil Procedure (Revised in 2019), if the people's court permits the application for appraisal, it shall organize both parties to negotiate to determine the appraiser with corresponding qualifications. If the parties fail to reach an agreement through consultation, the people's court shall appoint them.
