According to the provisions of the Marriage Law of China, the divorce agreement is a written agreement signed by both the husband and wife who are about to dissolve the marriage relationship on property division, child custody and visitation, spouse maintenance and child support. The divorce agreement must be in written form, signed by both parties, and filed or approved by the court or civil affairs department before it has legal effect. The divorce agreement shall state the identity information of the parties to the marriage relationship, namely, the married men and women. Secondly, it shall state the legality of divorce and the reasons for divorce. Finally, it shall state the disposition of the husband and wife's common property and debts and other agreements. In the divorce agreement, attention shall be paid to the fact that the contents agreed in the agreement shall not violate national laws and regulations, infringe the legitimate rights and interests of a third party, or deprive or restrict the legitimate rights of one party.
