The contract shall be renewed at the latest within one month after the expiration of the contract. If the employer and the employee intend to renew the contract, it is also possible to renew the contract before the expiration of the contract, but not later than one month from the date of continued employment, that is, within one month after the expiration of the contract, otherwise the employee will be paid double wages not more than November.
[Legal Basis]
Article 10 of the Labor Contract Law of the People's Republic of China states that to establish a labor relationship, a written labor contract shall be concluded.
If a labor relationship has been established but a written labor contract has not been concluded at the same time, a written labor contract shall be concluded within one month from the date of employment.
If an employer and a worker conclude a labor contract before employment, the labor relationship shall be established from the date of employment.
In Article 44 of the Labor Contract Law of the People's Republic of China, a labor contract shall be terminated in any of the following circumstances:
(1) The labor contract expires;
(2) Workers begin to enjoy basic old-age insurance benefits according to law;
(3) The worker dies, or is declared dead or missing by the people's court;
(4) The employing unit is declared bankrupt according to law;
(5) The business license of the employer is revoked, the employer is ordered to close down, or the employer decides to dissolve in advance;
(6) Other circumstances stipulated by laws and administrative regulations.
