At present, the separation recognized by the court is due to the incompatibility between husband and wife, the two parties do not live together with sexual life as the content, and do not perform other obligations of the husband and wife. However, how to collect the element that couples can divorce after two years of separation is a problem that must be identified in divorce.
 1. It is beneficial to sign a separation agreement. But in China, this legal system has not been established yet. As far as the current reality is concerned, the signing of the separation agreement is beneficial to avoid hasty divorce, help the court to find out the facts after the lawsuit, coordinate the property relationship between the husband and wife, and reduce domestic violence.
 2. Sleeping under the same roof but not in the same bed does not constitute separation. Because of the limitation of material living conditions, the vast majority of people have only one residence at present. Even if the couple's feelings are not harmonious, they usually have no choice but to have sex.
 3. Separation may not automatically dissolve the marriage relationship, and litigation may be dissolved. According to the current law, separation cannot automatically dissolve the marriage relationship. No matter how long the separation lasts, the marriage relationship will not be dissolved due to the continuation of separation.
