False litigation is to crack down on false lawsuits, which means that the parties, out of illegal motives and purposes, take advantage of the litigation rights granted by law to initiate civil litigation by means of false litigation subjects, facts and evidence, so that the court can make wrong judgments, rulings and mediation. It is similar to "malicious lawsuit". The subject of a false lawsuit is not one party, but both parties. It is the purpose of the lawsuit to infringe upon the legitimate rights and interests of the state, the collective or a third party by colluding with each other to reach a common malicious intention, using the civil procedure and by the hand of the court and the judge to obtain the support of civil judgment documents.
 Legal basis
 Article 199 of the Civil Procedure Law of the People's Republic of China, if a party believes that a legally effective judgment or order is wrong, he may apply to the people's court at the next higher level for retrial; If one party has a large number of people or both parties are citizens, they may also apply to the people's court that originally tried the case for retrial. If a party applies for retrial, the execution of the judgment or order shall not be suspended.
