Bigamy people still have the right to apply for divorce. They can reach an agreement on divorce with the other party, or they can sue for divorce in the court.
However, bigamists may have less or no share of common property and need to bear compensation for damages.
If the facts of bigamy are clear, the evidence is sufficient. Then bigamy may also be prosecuted for criminal responsibility.
Legal basis
Article 1091 [Divorce Damages] of the Civil Code of the People's Republic of China has the right to claim damages if one of the following circumstances leads to divorce:
（1） Bigamy;
（2） Cohabitation with others;
（3） Domestic violence;
（4） Abuse or abandon family members;
（5） There are other major faults.
