How to judge the parents after divorce, and how to judge the children to live with whom after divorce, is generally determined according to the principle of "conducive to the healthy growth of children". The third paragraph of Article 36 of China's Marriage Law stipulates: "After divorce, the children who are breast-feeding shall be raised by the breast-feeding mother in principle. If the two parties fail to reach an agreement due to a dispute over the upbringing of the children who are breast-feeding, the people's court shall make a judgment according to the interests of the children and the specific conditions of both parties."
