    If one party overdraws the credit card without the other party's knowledge during the existence of the husband and wife, it shall be treated as the joint debt of the husband and wife.
    Except that one of the husband and wife can prove that the creditor and debtor have clearly agreed that they are personal debts, or can prove that they fall under the circumstances specified in Paragraph 3 of Article 19 of the Marriage Law.
    The creditor has the right to demand repayment from any debtor. The creditors of joint and several debts may simultaneously or successively claim all or part of the payment to one or more of the debtors or all of them.
    Before the joint and several debts have been fully performed, all debtors shall remain jointly and severally liable.
