The difference between subrogation and subrogation:
1、 The heirs died at different times. In succession by subrogation, the heir dies before the decedent, while in succession by subrogation, the heir dies after the decedent's death but before the division of the estate.
2、 Inherited subjects are different. The successor in subrogation is only the direct junior blood relatives of the decedent, and the successor in subrogation may be all the legal heirs of the decedent.
3、 The scope of application is different. Succession by subrogation only applies to statutory succession, not testamentary succession. Succession by subrogation applies to statutory succession, as well as testamentary succession.
Article 11 of the Inheritance Law: If the children of the decedent die before the decedent, they shall be inherited by subrogation by their lineal descendants. In general, a subrogation heir can only inherit the share of the estate that his father or mother is entitled to.
