The following conditions shall be met when paying off debts on behalf of others:

    (1) According to the nature of the debt, it can be paid off by a third person.

    (2) There is no agreement between the creditor and the debtor that a third party may not pay off the debt.

    (3) There is no special reason for the creditor to refuse to pay off on behalf of the debtor, and there is no reasonable reason for the debtor to raise an objection.

    (4) The third party paying for the debtor must have the intention to pay for the debtor.

Article 64 of the Contract Law stipulates that if the parties agree that the debtor shall perform its obligations to a third person, the debtor shall be liable to the creditor for breach of contract if it fails to perform its obligations to the third person or fails to perform as agreed.
