If one spouse disposes of the common property without the consent of the other, it shall be deemed as an invalid civil act. If the joint property is disposed of without authorization, the disposer shall make compensation. The joint owners jointly enjoy the ownership of the commonly owned immovables or chattels.
[Legal Basis]
Article 95 of the Property Law of the People's Republic of China: "The joint owners shall jointly enjoy the ownership of the jointly owned real estate or chattel". (The Marriage Law will expire on December 31, 2020).
Article 299 of the Civil Code states that joint owners jointly enjoy the ownership of jointly owned immovables or movables. (The Civil Code will enter into force on January 1, 2021).
