    If the nursing staff has income, the nursing fee shall be calculated according to the standard of the lost time fee; If the nurses have no income or employ nursing workers, the nursing fees shall be calculated according to the local standards. Calculation of lost time cost: compensation for lost time cost shall be calculated according to the actual reduced loss for those with fixed income; If there is no fixed income but the average income level of the last three years can be proved, it shall be calculated according to the average income level of the last three years; If there is a fixed income but the average income level of the last three years cannot be proved, it shall be calculated according to the average wage of employees in the same or similar industries in the previous year.

    Article 1179 of the Civil Code states that if a person infringes upon another person and causes personal injury, he/she shall compensate medical expenses, nursing expenses, transportation expenses, nutrition expenses, hospital board subsidies and other reasonable expenses for treatment and rehabilitation, as well as reduced income due to missed work. If it causes disability, it shall also compensate for the cost of auxiliary equipment and disability compensation; If death is caused, funeral expenses and death compensation shall also be compensated. (The effective date of the Civil Code is January 1, 2021)
