Filing for divorce means that when both husband and wife unilaterally apply for divorce, the other party does not agree to divorce, or although both parties agree to divorce, no agreement has been reached on the division of common property and the maintenance, education, medical expenses, etc. of their children, the parties to the divorce proceedings may submit a divorce petition to the people's court, which generally adopts two ways to solve the problem after accepting it:
1. Mediation divorce means that the two parties to a divorce reach an agreement on the division of property, child rearing and other issues under the mediation of the court, and the people's court approves their divorce and prepares a civil mediation statement for divorce as a divorce legal document for both parties.
2. Divorce judgment means that the people's court makes a divorce judgment on the joint property of the husband and wife and on the upbringing of children in the specific circumstances of the divorce case when mediation is invalid.
