According to China's Marriage Law, parents have the obligation to raise and educate their minor children. This obligation is legal, and the relationship between parents and children will not be eliminated by the divorce of both spouses.
After divorce, whether the children are directly raised by the father or the mother, they are still children of both parents. Parents still have the right and obligation to support and educate their children.
If both parents or one of them does not raise a child, the other party can sue the court for payment of alimony. The specific alimony shall be determined according to the local living standard, the economic conditions of the payer and the actual living consumption of the child.
