A divorce by agreement is considered a formal divorce. Procedures for divorce by agreement: the husband and wife reach an agreement on divorce, and sign a divorce agreement through consultation on child rearing, property division, and debt handling. If both parties apply for divorce registration in person at the marriage registration authority and it is verified by the marriage registration authority, both parties shall go to the marriage registration authority to get the divorce certificate after the specified 30 days have expired.

Article 1076 of the Civil Code states that if the husband and wife divorce voluntarily, they shall sign a written divorce agreement and apply for divorce registration in person at the marriage registration office.
The divorce agreement shall specify the intention of both parties to divorce voluntarily and the consensus on matters such as child rearing, property and debt handling.
