The second instance of a civil action is already the final instance. If it is believed that there is some error or new evidence, it may apply for a retrial.
According to the relevant laws and regulations of our country, the people's courts try civil cases and implement the collegial, withdrawal, public trial and the system of the second instance being the final instance in accordance with the laws and regulations.
Article 199 of the Civil Procedure Law stipulates that if a party believes that a legally effective judgment or order is wrong, he may apply to the people's court at the next higher level for retrial. In cases where one party has a large number of people or both parties are citizens, he may also apply to the people's court of the original trial for retrial. If a party applies for retrial, the execution of the judgment or order shall not be suspended.
