If they are not satisfied with the result of the labor arbitration, they may bring a lawsuit to the court within 15 days after the award is served. The prosecution procedure is the same as that of ordinary civil action. Note that when prosecuting, it is necessary to identify the labor arbitration errors and submit evidence materials. However, if the employer is not satisfied with the award in Article 47 of the Labor Dispute Mediation and Arbitration Law, it cannot bring a lawsuit. Article 47 of the Labor Dispute Mediation and Arbitration Law, the following labor disputes, unless otherwise provided for in this Law, shall be final and the arbitral award shall have legal effect as of the date of making it: (1) disputes involving the recovery of labor remuneration, medical expenses for work-related injuries, economic compensation or compensation, which shall not exceed the amount of the local minimum monthly wage for 12 months; (2) Disputes arising from the implementation of national labor standards in terms of working hours, rest and vacation, social insurance, etc. Article 48 If a worker is not satisfied with the arbitral award as prescribed in Article 47 of this Law, he may bring a lawsuit to the people's court within 15 days from the date of receiving the arbitral award. Article 50 If a party is not satisfied with the arbitral award of a labor dispute case other than those specified in Article 47 of this Law, he may bring a lawsuit to the people's court within 15 days from the date of receiving the arbitral award; If no action is brought within the time limit, the award shall become legally effective.
