This part of personal income belongs to the incentive income of employment, which is the category of income from wages and salaries. There is no provision on the 13th month's salary in the national legislation; Therefore, the amount of salary payment in the 13th month, whether it is basic salary or full salary, or bonus, should be determined completely according to the agreement between the enterprise and employees, or the provisions of the enterprise's salary and welfare policy.
 Legal basis
 Article 74 of the Civil Servant Law of the People's Republic of China, if a civil servant has husband wife relationship, direct blood relationship, collateral blood relationship within three generations, or close marriage relationship, he or she may not work in a position where both parties in the same organ are directly subordinate to the same leader or have a direct leadership relationship at a higher or lower level, Nor may they engage in organization, personnel, discipline inspection, supervision, audit and financial work in the organs where one of them holds the leading position.
 Civil servants shall not serve as leading members in the industry supervision or competent departments of their spouses, children and enterprises or for-profit organizations run by their spouses.
 If, due to special geographical or work nature, it is necessary to flexibly implement the withdrawal from office, it shall be stipulated by the competent department of civil servants at or above the provincial level.
