The way to deal with the invalidity of legacy maintenance agreement: return property and compensate for losses. After a civil act is confirmed to be invalid or revoked, the property acquired by the party as a result of the act shall be returned to the party suffering losses.
Article 31 of the Inheritance Law stipulates that legacy maintenance agreements refer to the agreements on maintenance and legacy concluded between citizens (dependents and legatees) and their dependents and collective ownership organizations. In accordance with the agreement, the dependents shall bear the obligation to support the citizen alive and die, and enjoy the right to bequeath.
Article 58 of the Contract Law: "After the contract is invalid or cancelled, the property acquired as a result of the contract shall be returned; if it cannot be returned or is unnecessary to return it, it shall be compensated at a discount. The party at fault shall compensate the other party for the losses it has suffered as a result. If both parties are at fault, they shall bear their respective responsibilities."
