 Legal basis
 Article 107 of the Civil Servant Law of the People's Republic of China, if a civil servant resigns from public office or retires, the former leading member or civil servant holding a leading position at or above the county level will not be employed by an enterprise or other for-profit organization directly related to the original business within three years of resignation, and other civil servants will not be employed within two years of resignation, They shall not engage in profit-making activities directly related to the original business. If a public servant who has resigned from public office or has committed any act in violation of the provisions of the preceding paragraph after retirement, the department in charge of public servants at the same level as the original organ shall order him to make corrections within a time limit; If it fails to make corrections within the time limit, the market supervision department at or above the county level shall confiscate the illegal income of the personnel during their employment, order the receiving unit to dismiss the personnel, and impose a fine of not less than one time but not more than five times the illegal income of the punished personnel on the receiving unit according to the seriousness of the circumstances.
