    The marital property agreement refers to the agreement made by both men and women, on the basis of equality and voluntariness, through friendly negotiation, on the ownership, management, use of earnings, disposal and debt settlement of the property acquired after marriage, and property liquidation upon dissolution of marriage. Once the husband and wife have agreed on the property system, they will exclude the application of the statutory property system. The implementation of the agreed property system by couples can simplify the marital property relationship, help couples flexibly handle the property relationship, adapt to the special circumstances of marriage and family life, and meet the different needs of some couples. The contents of the marital property agreement mainly include:
    1. Clarify the scope and ownership of premarital property;
    2. Clarify the ownership and use of the joint property of husband and wife;
    3. Establish the rights and obligations of both husband and wife in family life;
    4. Effectiveness and cancellation of the agreement;
    5. Liability for breach of contract. Article 19 of China's new Marriage Law stipulates that marital property can stipulate that the property acquired during the marriage relationship and the pre marital property shall belong to their own, joint, or part of their own, or part of their joint ownership. The agreement shall be in writing. If there is no agreement or the agreement is not clear, the provisions of Articles 17 and 18 of this Law shall apply. The agreement between husband and wife on the property acquired during the marriage relationship and the prenuptial property shall be binding on both parties. If the husband and wife agree that the property acquired during the marriage relationship shall belong to each other, and the debts of the husband or wife to the outside world are known to the third party, the property owned by the husband or wife shall be used to pay off.
