 First, evidence collection of basic conditions of both parties
 Including but not limited to the nature of work, working environment, income, living conditions, education level, character cultivation, etc., through comparative analysis of the basic conditions of both parties, highlight the favorable factors. For example, the ideological quality of one party is particularly important in the fight for child custody, because the ideological quality of the direct provider will directly affect the healthy growth of the next generation.
 Second, evidence collection of both parents' basic conditions
 Most of the time, it is not either of the husband and wife who really take care of the children, especially for preschool children, usually the parents of one party. Therefore, the child's previous living environment, as well as the opinions and physical conditions of the parents who have taken care of the child for a long time, are often an important aspect that affects the child's custody.
 3、 Evidence collection of children's living environment
 The principle of handling child rearing in divorce cases is not to affect the healthy growth of children. If both parties divorce, but one party is close to the school, or the living quarters are mature, it is most beneficial for the children to learn and live. Of course, it will be more likely to get custody of the children. Therefore, evidence collection in this regard is also necessary.
 4、 Collect children's opinions
 Generally, the court will carefully listen to the opinions of children over 10 years old when dealing with the issue of upbringing, and make a written entry. Before or during divorce, it is particularly important to do a good job in children's ideological work and make them willing to live with themselves.
 Article 36 of the Marriage Law of the People's Republic of China
 After divorce, parents still have the right and obligation to support and educate their children. After divorce, children who are breast-feeding shall be brought up by the breast-feeding mother in principle. If the two parties fail to reach an agreement due to a dispute over the upbringing of a child after breast-feeding, the people's court shall make a judgment according to the rights and interests of the child and the specific circumstances of both parties.
