1、 The sentencing standards for the crime of smuggling precious animals and precious animal products:
1. Whoever smuggles precious animals and their products whose import and export are prohibited by the State shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years and shall also be fined.
2. If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment and confiscation of property.
3. If the circumstances are relatively minor, he shall be sentenced to fixed-term imprisonment of not more than five years and shall also be fined.
4. If a unit commits this crime, it shall be fined, and the persons who are directly in charge and other persons who are directly responsible for it shall be punished in accordance with the provisions of Articles 1, 2, 3.
2、 The crime of smuggling precious animals and precious animal products refers to the act of illegally carrying, transporting and mailing precious animals and precious animal products into and out of the border (frontier) in violation of customs laws and regulations, evading customs supervision. Precious animals refer to the rare and precious animals that are Chinese specialties and the wild animals that are not Chinese specialties but have been listed as rare and endangered species in the world.

Paragraph 2 of Article 151 of the Criminal Law of the People's Republic of China states that anyone who smuggles cultural relics, gold, silver and other precious metals prohibited by the State from export, or precious animals and their products prohibited by the State from import or export, shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years and shall also be fined; If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be sentenced to confiscation of property; If the circumstances are relatively minor, he shall be sentenced to fixed-term imprisonment of not more than five years and shall also be fined.
