Procedures for house testamentary inheritance:
1. Go to the Inherited Property Notary Office to handle the property inheritance notarization;
2. Prepare death certificates, heirs' identity certificates (wills), house ownership certificates and other materials;
3. Go to the property transaction center to handle the property inheritance procedures.
According to Item 1 and Item 2 of Paragraph 2 of Article 14 of the Interim Regulations on Real Estate Registration, the application for real estate registration due to sale or creation of mortgage shall be jointly applied by both parties.
Where a person inherits or accepts a legacy to acquire the right of real estate, he may apply unilaterally by the party concerned.
The parties or their agents shall apply to the real estate registration authority for real estate registration.
Legal basis
Article 14 of the Detailed Rules for the Implementation of the Interim Regulations on Real Estate Registration shall be jointly applied for by both parties in case of application for real estate registration due to sale, creation of mortgage, etc.
Under any of the following circumstances, the party may apply unilaterally:
（1） The first application for registration of unregistered real estate;
（2） Inheriting or accepting legacy to acquire real estate rights;
（3） The people's court, arbitration commission or the people's government's effective decision establish, change, transfer or eliminate the real estate rights;
（4） The obligee's name, title or natural condition changes and applies for registration of change;
（5） The real estate is lost or the obligee abandons the real estate right and applies for cancellation of registration;
（6） Applying for correction registration or objection registration;
（7） Other circumstances that may be unilaterally applied for by the parties as prescribed by laws and administrative regulations.
Article 15
The parties or their agents shall apply to the real estate registration authority for real estate registration.
The real estate registration authority shall record the items applied for registration in front of the real estate register, and the applicant may withdraw the registration application.
