The rules for determining the liability for rear end traffic accidents are:
1、 The rear vehicle shall bear full responsibility for the rear collision traffic accident caused by the rear vehicle hitting the front vehicle while driving;
2、 At night, the front car does not have a tail lamp, and the rear car bears the secondary responsibility of the accident, while the rear car bears the primary responsibility of the accident.
Article 43 of the Road Traffic Safety Law stipulates that for motor vehicles running in the same lane, the rear vehicle shall keep a safe distance from the front vehicle enough to take emergency braking measures. Under any of the following circumstances, overtaking is not allowed:
(1) The vehicle ahead is turning left, turning around or overtaking;
(2) It is possible to meet the oncoming car;
(3) The front vehicles are police vehicles, fire engines, ambulances and engineering rescue vehicles carrying out emergency tasks;
(4) Passing through railway crossings, intersections, narrow bridges, curves, steep slopes, tunnels, crosswalks, sections with large traffic flow in urban areas, etc. without overtaking conditions.
