If the other party's purpose is to rent a car, but the rent is delayed, it can only file a civil lawsuit to return the occupied car and pay the unpaid rent. If the other party has illegally occupied the vehicle for the purpose of defrauding the vehicle by renting a car, it is a crime of fraud and can be reported to the police for filing.
 The crime of fraud refers to the act of defrauding a large amount of public and private property with the purpose of illegal possession by deception. According to the relevant laws and regulations of our country, anyone who swindles public or private property, if the amount is relatively large, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also, or shall only, be fined; If the amount is huge or if there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years and shall also be fined; If the amount is especially huge or if there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment and shall also be fined or sentenced to confiscation of property. Where this Law provides otherwise, such provisions shall prevail.
 Legal basis
 Article 19 of the Criminal Procedure Law of the People's Republic of China, investigation of criminal cases shall be conducted by public security organs, unless otherwise provided by law.
 Crimes that infringe upon citizens' rights and impair judicial justice, such as illegal detention, extortion of confessions by torture, and illegal search, which are committed by judicial personnel by taking advantage of their functions and powers and which are discovered by the People's Procuratorate in its legal supervision of litigation activities, may be placed on file for investigation by the People's Procuratorate. When it is necessary for a people's procuratorate to directly accept a major criminal case committed by a functionary of a State organ under the jurisdiction of a public security organ by taking advantage of his power, the case may be placed on file for investigation by a people's procuratorate upon decision of a people's procuratorate at or above the provincial level.
 Cases of private prosecution shall be accepted directly by the people's courts.
