（1） The object of this crime is the equal rights of the victim in the family members. The objects are only limited to the elderly, young, sick or other family members who have no ability to live independently.
 （2） Objective elements: This crime is objectively manifested as an act of refusing to support old, young, sick or other family members who have no ability to live independently. The circumstances are atrocious.
 （3） Main element: the subject of this crime is a special subject, and must be a person who has the legal obligation to support the abandoned and has the ability to support them.
 （4） Subjective elements, this crime is intentional in the subjective aspect.
 Article 261 of the Criminal Law stipulates that anyone who refuses to support a person who is old, young, ill or has no ability to live independently, if the circumstances are flagrant, shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance.
