The house bought after marriage is written with the name of one party, not necessarily his. The ownership of the house should be judged according to the specific situation:
 1. If there is no clear agreement between the husband and the wife on the house purchased during the marriage, the house property certificate only contains the name of one person, which should be recognized as the joint property of the husband and the wife, not only the party with the name;
 2. If the property right of a real estate purchased by the parents of both parties is registered in the name of a child of one party, the real estate can be deemed to be jointly owned by both parties according to their parents' share of capital contribution, unless otherwise agreed by the parties.
 Article 39 of the Marriage Law states that at the time of divorce, the joint property of the husband and wife shall be handled by both parties through agreement; If no agreement is reached, the people's court shall make a judgment on the basis of the specific conditions of the property and the principle of taking care of the rights and interests of children and women. The rights and interests enjoyed by the husband or wife in the household land contract management shall be protected according to law.
