The invalidity of the labor contract does not necessarily lead to the result of unilateral rescission (or legal rescission, fault rescission). The invalidation of a labor contract may have two legal consequences:
First, both parties sign a new labor contract or change the invalid clauses in the original contract;
Second, the non fault party with invalid labor contract exercises the right to unilaterally terminate the labor relationship between both parties.
