An adopted child may inherit the estate. The relationship between adopted children and adopters is a legal fiction of the relationship between parents and children. However, the legal consequences of this fictional relationship are equivalent to the blood relationship between the biological parents and children.
According to Article 10 of the Inheritance Law, spouse, children and parents are the first order heirs. Among them, children include legitimate children, illegitimate children, adopted children and step children with dependency relationship. Therefore, once the adopted children relationship is confirmed, their inheritance rights and interests are protected by law.
At the same time, according to the provisions of Article 19 of the Opinions of the Supreme Court on the Implementation of the Inheritance Law, adopted children who have done their duty to support their adoptive parents, while supporting their biological parents more, can not only inherit the inheritance of their adoptive parents, but also share the appropriate inheritance of their biological parents.
