When caught smoking in Internet cafes by the public security, they are usually warned, criticized and educated. But some places are strict.
 The Fire Control Law of the People's Republic of China clearly stipulates this behavior:
 Those who use open fire in violation of regulations or smoke or use open fire in places with fire and explosion risks shall be warned or fined less than 500 yuan; If the circumstances are serious, they shall be detained for less than 5 days. May be detained for less than five days.
 If the business unit of Internet access service business premises violates the provisions of these Regulations and commits one of the following acts, the public security organ shall give a warning and may also impose a fine of less than 15000 yuan; If the circumstances are serious, it shall be ordered to suspend business for rectification until the Cultural Administration Department revokes the Network Culture Business License:
 （1） Failing to stop smoking by using open fire for lighting, or failing to hang signs prohibiting smoking;
 （2） It is allowed to bring in or store inflammable and explosive materials;
 （3） Installing fixed closed door and window fences at business premises;
 （4） Blocking or locking doors and windows, safe evacuation routes or emergency exits during business hours;
 （5） Stop implementing safety technical measures without authorization.
 Legal basis
 Those who violate the provisions of this law in accordance with the Fire Control Law of the People's Republic of China and commit one of the following acts shall be given a warning or fined less than 500 yuan; If the circumstances are serious, they shall be detained for not more than five days: (1) those who enter places where inflammable and explosive dangerous goods are produced and stored in violation of fire safety regulations; （2） Using open fire for operation in violation of regulations, or smoking or using open fire in places with fire and explosion risks.
 Article 32 of the Regulations on the Administration of Business Sites of Internet Access Services, if an operating entity of business sites of Internet access services violates the provisions of these Regulations and commits one of the following acts, the public security organ shall give a warning and may concurrently impose a fine of not more than 15000 yuan; If the circumstances are serious, it shall be ordered to suspend business for rectification until the Cultural Administration Department revokes the Network Culture Business License: (1) using open flames to light or not stopping smoking when it is found, or failing to hang a sign prohibiting smoking; （2） It is allowed to bring in or store inflammable and explosive materials; （3） Installing fixed closed door and window fences at business premises; （4） Blocking or locking doors and windows, safe evacuation routes or emergency exits during business hours; （5） Stop implementing safety technical measures without authorization.
