This is because the marriage leave is taken based on the application of employees, and employees can apply in advance or later, so that the marriage leave can be taken together with the legal holiday. According to Article 3 of the Regulations on Paid Annual Leave of Employees, national statutory holidays and rest days are not included in annual leave. In addition, Article 6 of the Measures for the Implementation of Paid Annual Leave of Enterprise Employees stipulates that "the leave legally enjoyed by employees such as home leave, marriage and funeral leave, maternity leave and other national holidays, as well as the paid period of work injury downtime, shall not be included in annual leave." However, there is no clear law or regulation in China on whether legal leave days must be postponed during marriage leave.
