The objective aspect of this crime is that the perpetrator must have bigamy. A person who has a spouse and marries another person, or marries another person knowing that he has a spouse, shall constitute a crime of bigamy. The boundary between this crime and non crime should distinguish the boundary between bigamy and temporary cohabitation. Cohabitation means that both men and women temporarily live together in the name of husband and wife without marriage, which does not constitute the crime of bigamy

    Legal basis

    Article 258 of the Criminal Law of the People's Republic of China [Crime of Bigamy] Whoever commits bigamy with a spouse, or knowingly marries another person with a spouse, shall be sentenced to fixed-term imprisonment of not more than two years or criminal detention.
