    If one party has gambling behavior, it is not conducive to family life and the development of marital relationship. If he or she can choose to end the marriage relationship between the two parties, he or she can choose to divorce by agreement or file a lawsuit to the people's court for divorce.
    The following evidence shall be prepared:
    1. Provide marriage registration certificate.
    2. Provide witness testimony or other relevant evidentiary materials on the basic marital status.
    3. Provide a list of personal property of both parties before marriage, joint property of husband and wife, or property of other family members.
    4. For the disputed property, the source of the property, the time of acquisition and other supporting materials, such as invoices, shall be provided.
    5. Provide evidential materials for the feelings after marriage, whether the feelings after marriage are good or bad, whether they are separated, and the time and reason of separation.
    6. Provide evidentiary materials and witness clues of the main reasons for divorce.
    7. The number of children and their names, gender, birth time, whether they are legitimate, illegitimate or adopted or step children, the health status of the children, and the evidence of adult children's inability to live independently shall be provided.
    8. Provide evidentiary materials of economic income and expenditure of both parties.
    9. Provide proof materials of housing conditions.
    10. If a divorce lawsuit has been filed before, it should be explained whether it is to withdraw the lawsuit or make a reconciliation, or whether the divorce is not allowed. The original or copy of the original judgment, mediation statement or ruling shall be provided.
    Legal basis:
    Article 32 of the Marriage Law of the People's Republic of China
    If one of the men and women requests a divorce, the relevant department may mediate or directly file a divorce lawsuit with the people's court.
    When hearing divorce cases, the people's courts shall conduct mediation; If the relationship has really broken down and the mediation is invalid, divorce shall be granted.
    Under the following circumstances
    1、 If mediation fails, divorce shall be granted:
    (1) Bigamy or cohabitation of a married person with another person;
    (2) Committing domestic violence or maltreating or abandoning family members;
    (3) Those who have bad habits such as gambling and drug abuse and refuse to change after repeated education;
    (4) Separated for two years due to emotional discord;
    (5) Other situations that lead to the breakdown of the relationship between husband and wife.
    Divorce shall be granted if one party is declared missing and the other party files a divorce lawsuit.
