1、 Project claim process:
1. After the claim event occurs, the notice of claim intention shall be sent to the supervising engineer.
2. After sending the notice of claim intention, submit the claim report and relevant data for compensating economic losses and (or) extending the construction period to the supervising engineer.
3. The supervising engineer shall reply after receiving the claim report and relevant data submitted by the contractor.
4. After receiving the claim report and relevant data submitted by the Contractor, the supervising engineer does not reply or make further requirements to the Contractor within the specified time, it shall be deemed that the claim has been accepted.
5. When the claim event continues, the Contractor shall send a notice of intention to claim to the supervising engineer periodically.
6. Provide the supervising engineer with relevant data and final claim report within the specified time after the end of the claim event.
2、 The classification of project claims mainly includes:
1. Claims caused by material quality problems or untimely material supply;
2. Claim for increase of labor cost, material cost and equipment cost due to temporary construction interruption and work efficiency reduction due to human factors;
3. The adverse natural conditions and artificial obstacles lead to increased cost losses or claims caused by construction delay.
[Legal Basis]
Article 803 of the Civil Code of the People's Republic of China states that if the Employer fails to provide raw materials, equipment, sites, funds and technical data at the agreed time and requirements, the Contractor may extend the project date and has the right to claim compensation for losses such as work stoppage and slowdown.
