The execution of probation punishment in our country implements community correction. Community correction refers to the execution of non custodial punishment, in which eligible criminals are placed in the community and special state organs, with the assistance of relevant social groups, non-governmental organizations and social volunteers, correct their criminal psychology and behavior within the time limit determined by the judgment, ruling or decision, and promote their smooth return to society.
Community correction is a way of execution opposite to imprisonment correction. It is also a rational choice made by human beings to overcome the limitations of cross infection and retribution of criminals in prison.
[Legal Basis]
In Article 76 of the Criminal Law, a criminal whose sentence has been suspended shall be subject to community correction according to law during the probation period for suspension of sentence. If there is no circumstance specified in Article 77 of this Law, the original sentence will not be executed at the expiration of the probation period for suspension of sentence and will be publicly announced.
