After the procuratorate approves the arrest, it will generally bring the case to the court for trial within three months (two months for investigation and one month for review and prosecution). If the case is complicated, the time may be extended, but it should not exceed 12 months at most. According to the Criminal Procedure Law of China, the investigation period of the public security organ is generally two months after the procuratorate approves the arrest. If the case is complicated, it can be extended for up to seven months after approval. After the public security organ completes the investigation, it will transfer the case to the procuratorate for review and prosecution. The time for review and prosecution is generally one month (that is, one month for prosecution to the court). However, if the procuratorate believes that the case is unclear, it can request the public security organ to conduct supplementary investigation. The time for supplementary investigation is one month, and supplementary investigation can be conducted twice.
In Article 124 of the Criminal Procedure Law of the People's Republic of China, the period of custody for investigation after the arrest of a criminal suspect shall not exceed two months. If the case is complicated and cannot be concluded at the expiration of the time limit, it may be extended for one month with the approval of the People's Procuratorate at the next higher level.
