    1. If the employee does not work within one month after the shutdown, the employer will still pay the salary according to the standard agreed in the labor contract.

    2. If the production is stopped for more than one month, the salary can be paid in two cases:

    (1) If the laborer provides normal labor, the labor remuneration paid to the laborer shall not be lower than the local minimum wage standard;

    (2) If normal labor is not provided, wages can be paid at a level lower than the minimum wage standard. That is, since February, employees have not provided labor, and the company has to pay the local minimum living security. Each region has its own regulations.

    Overtime pay on statutory holidays is different from that on public holidays. If an employer arranges workers to work on statutory holidays, it shall pay no less than three times of the original salary. If you work overtime on public holidays and cannot take compensatory time off, you should pay no less than twice the original salary. However, if you take compensatory leave after working overtime on public holidays, you can no longer pay overtime pay.

    Legal basis

    Article 12 of the Interim Provisions on Wage Payment: If the unit shuts down or stops production within a wage payment cycle due to reasons not attributable to workers, the employer shall pay workers wages according to the standards specified in the labor contract. If the wage payment period exceeds one, if the laborer provides normal labor, the labor remuneration paid to the laborer shall not be lower than the local minimum wage standard; If the laborer does not provide normal labor, it shall be handled in accordance with relevant national regulations.
